1. AGREEMENT TO TERMS
By accessing or using FirePot Fashions LLC's website (roamingfirepot.com), mobile applications, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.
These Terms constitute a legally binding agreement between you and FirePot Fashions LLC ("FirePot," "we," "us," or "our"). By placing an order, creating an account, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. ELIGIBILITY
You must be at least 18 years old to use our Services and make purchases. By using our Services, you represent and warrant that you are of legal age to form a binding contract. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian.
3. PRODUCTS & PRICING
All products are custom-designed, premium streetwear items printed on demand through our fulfillment partner, Printful. Product images are for illustrative purposes and may vary slightly from the actual product due to screen settings and printing processes.
Pricing: All prices are listed in U.S. Dollars (USD) and are subject to change without notice.
Product Availability: We reserve the right to modify, discontinue, or limit the availability of any product at any time without prior notice.
Accuracy: While we strive for accuracy, we do not warrant that product descriptions, pricing, or availability are error-free. We reserve the right to correct any errors and to cancel orders affected by pricing or description errors.
Bundles & Promotions: Bundle pricing and promotional offers are subject to availability and may be modified or discontinued at any time.
4. ORDERS & PAYMENT
4.1 Order Acceptance All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, suspected fraud, or violations of these Terms.
4.2 Payment Payment is due at the time of purchase. We accept major credit cards, debit cards, and other payment methods as displayed at checkout. By providing payment information, you represent and warrant that you are authorized to use the payment method.
4.3 Taxes You are responsible for all applicable sales taxes, VAT, or other taxes based on your billing or shipping address.
5. 🚚 FULFILLMENT AND SHIPPING
Fulfillment Time: 2-7 business days for printing, quality control, and packaging
Shipping Time: Additional 3-8 business days after fulfillment (domestic U.S.)
Total Delivery Time: Approximately 5-15 business days from order placement
Shipping Origin: Products ship from our fulfillment partner's facilities located throughout the United States
Tracking: You will receive tracking information via email once your order ships
International Shipping: International orders may be subject to customs duties, taxes, and fees, which are the responsibility of the customer
6. ⚖️ SHIPPING LIABILITY & RISK OF LOSS
FirePot Fashions LLC is responsible for safely packaging and delivering your order to our shipping carrier (USPS, FedEx, UPS, DHL, etc.). Once your package is scanned and accepted by the carrier, risk of loss and title transfer to you.
What This Means:
- We provide full tracking information so you can monitor your shipment
- Once tracking shows "in transit" or "delivered," the carrier assumes responsibility
- We are not liable for packages lost, stolen, or damaged after carrier acceptance
If You Experience Issues:
- Lost or delayed packages: Contact the carrier directly using your tracking number
- Stolen packages (porch theft): File a report with local authorities and contact the carrier
- Damaged items: Contact us within 48 hours of delivery @ firepotfashions@gmail.com with photos—we'll work with you to resolve it
We recommend selecting signature confirmation at checkout for high-value orders or shipping to a secure location.
7. RETURNS, REFUNDS & DAMAGED ITEMS
Due to the custom, print-on-demand nature of our products, we do not accept returns for change of mind, size exchanges, or buyer's remorse. Please review product descriptions, size charts, and images carefully before purchasing.
7.1 Misprinted, Damaged, or Defective Items If you receive a misprinted, damaged, or defective item, we will submit a claim to our fulfillment partner, Printful. You must report issues within 25 days of receipt to be eligible for coverage. Please contact us at firepotfashions@gmail.com with your order number and photos of the defect.
7.2 Lost in Transit If your order is lost in transit and tracking shows no movement for an extended period, we will submit a claim to Printful. You must report non-delivery within 25 days of the estimated delivery date.
7.3 No Refunds/Replacements We cannot offer refunds or replacements for:
Items marked "Delivered" by the carrier
Incorrect shipping addresses provided by the customer
Orders refused or unclaimed by the customer
Damage occurring after delivery to the customer
7.4 Refund Processing Approved refunds will be issued to the original payment method within 5-10 business days of approval.
8. 📱 SMS/TEXT MESSAGE MARKETING
By subscribing to our SMS service, you consent to receive recurring automated marketing and transactional messages (such as order updates, shipping notifications, and promotional offers) at the phone number provided.
Consent: Consent is not a condition of purchase. You may opt out at any time.
Message Frequency: Message frequency varies (up to 10 messages per month).
Costs: Message and data rates may apply based on your mobile carrier plan.
Opt-Out: Reply STOP to opt out at any time. Reply HELP for assistance or contact firepotfashions@gmail.com.
Carrier Liability: Carriers are not liable for delayed or undelivered messages.
Supported Carriers: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, and other major U.S. carriers.

9. ACCOUNT REGISTRATION
You may create an account to access certain features, track orders, and receive exclusive offers. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
10. INTELLECTUAL PROPERTY
All content, designs, logos, graphics, text, images, videos, and branding on FirePot Fashions LLC's website and products are the exclusive property of FirePot Fashions LLC or licensed to us. This includes but is not limited to:
FirePot branding and logos
Brick-wall-inspired patterns and designs
Product photography and mockups
Website design and layout
You may not reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, or transmit any of our content without express written permission from FirePot Fashions LLC.
11. PROHIBITED USES
You agree not to:
Use our Services for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to our systems, servers, or networks
Transmit viruses, malware, or any other malicious code
Impersonate FirePot Fashions LLC, our employees, or representatives
Violate any applicable local, state, national, or international laws or regulations
Use our products for unauthorized resale or commercial purposes without prior written consent
Engage in any activity that interferes with or disrupts our Services
Use automated systems (bots, scrapers) to access our Services without permission
Harass, abuse, or harm other users or our staff
12. USER-GENERATED CONTENT
If you submit reviews, photos, comments, or other content to our website or social media channels, you grant FirePot Fashions LLC a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content for marketing and promotional purposes.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by Minnesota law:
FirePot Fashions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or Services, including but not limited to loss of profits, data, or goodwill.
Our total liability for any claim arising out of or relating to these Terms or your use of our Services shall not exceed the amount you paid for the product in question.
We do not guarantee uninterrupted, secure, or error-free operation of our Services.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless FirePot Fashions LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
Your violation of these Terms
Your misuse of our Services
Your violation of any third-party rights, including intellectual property rights
Any content you submit or transmit through our Services
15. GOVERNING LAW & JURISDICTION
These Terms are governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Minnesota, and you consent to the personal jurisdiction of such courts.
16. DISPUTE RESOLUTION
16.1 Informal Resolution For disputes under $10,000, you agree to first attempt informal resolution by contacting us at firepotfashions@gmail.com with a detailed description of the dispute. We will attempt to resolve the matter within 30 days.
16.2 Arbitration If informal resolution is unsuccessful, disputes may be resolved through binding arbitration in Minnesota in accordance with the American Arbitration Association (AAA) Commercial Arbitration Rules. The arbitrator's decision will be final and binding.
16.3 Small Claims Court Either party may elect to resolve disputes in small claims court in Minnesota if the dispute qualifies.
16.4 Class Action Waiver You agree to resolve disputes on an individual basis only and waive any right to participate in a class action lawsuit or class-wide arbitration.
17. FORCE MAJEURE
FirePot Fashions LLC is not liable for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to:
Acts of God, natural disasters, pandemics, or public health emergencies
War, terrorism, civil unrest, or government actions
Labor disputes, strikes, or supplier delays
Interruptions in transportation, utilities, or communications
Failures or delays by our fulfillment partners or carriers
18. CHANGES TO TERMS
We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes become effective immediately upon posting to our website. Material changes will be communicated via email or prominent website notice. Your continued use of our Services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
19. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
20. WAIVER
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of FirePot Fashions LLC.
21. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and FirePot Fashions LLC regarding your use of our Services and supersede all prior agreements and understandings.
